Terms of Use

01 Acceptance of Terms

These Terms of Use ("Terms") form a legal agreement between you ("you" or "user") and thehelloworld.app ("we," "us," or "our"), the provider of the Address Finder mobile application (the "App"). By accessing or using the App, you confirm that you have read, understood, and agree to these Terms, together with our Privacy Policy, which is incorporated here by reference.

02 Description of the Service

Address Finder is a native iOS application that lets you save, organize, search, and navigate to addresses. Features include an interactive map, saved and favorite addresses, category organization, recent and nearby address views, photo attachments, QR code generation, duplicate detection, JSON import and export, home screen widgets, and support for multiple languages.

The App stores your saved addresses locally on your device. We may update, modify, add, or remove features at any time without prior notice.

03 Eligibility

You must be at least 13 years old, or the minimum age required to form a binding contract in your jurisdiction, to use the App. By using the App, you represent that you meet this requirement and that you will comply with these Terms and all applicable laws.

04 License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes on Apple devices that you own or control, as permitted by the Apple App Store Terms of Service. This license does not allow you to:

• copy, modify, reverse engineer, decompile, or disassemble the App, except where permitted by law;
• rent, lease, lend, sell, redistribute, or sublicense the App;
• remove or alter any proprietary notices; or
• use the App in any way that violates applicable law or these Terms.

05 Location, Camera & Photo Permissions

Core features of the App rely on your device's location to show your position on the map, find nearby addresses, and improve geocoding results. The App may also request access to your camera and photo library so you can attach photos to saved addresses.

These permissions are optional and are requested only when needed. You can grant or revoke them at any time in your device's Settings. Disabling certain permissions may limit or disable related features of the App.

06 Your Data & Backups

Addresses, photos, categories, and related content you create are stored locally on your device. You are solely responsible for the content you save and for maintaining your own backups of important data.

The App may offer import, export, and automatic backup features to help you manage your data. We are not responsible for any loss, corruption, or unavailability of data, including data lost due to device failure, deletion of the App, software updates, or your own actions. 07 Subscriptions & Payments

The App offers an optional premium subscription ("Pro") that unlocks additional features such as the removal of advertisements and enhanced export options. Pricing, billing periods, and any free trial are shown in the App at the point of purchase and may vary by region and over time.

Billing and renewal

• Payment is charged to your Apple ID account upon confirmation of purchase.
• Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period at the then-current price.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.

Managing and cancelling

You can manage or cancel your subscription, and turn off auto-renewal, in your Apple ID account settings on your device. Cancellation takes effect at the end of the current billing period. Refunds are handled by Apple in accordance with the App Store Terms of Service; we generally cannot issue refunds directly.

08 Advertising & Tracking

The free version of the App is supported by advertising provided through Google AdMob, which may include banner, interstitial, and rewarded ads. Purchasing a Pro subscription removes advertisements.

In line with Apple's App Tracking Transparency framework, the App will ask for your permission before tracking your activity across other companies' apps and websites for advertising purposes. You may grant or deny this permission, and change it later in your device's Settings. Advertising and related data practices are described further in our Privacy Policy.

09 Acceptable Use

You agree not to use the App to:

• violate any applicable law, regulation, or third-party right;
• store or share content that is unlawful, harmful, or infringing;
• interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems; or
• use the App in any manner that could damage, disable, or impair its operation.

10 Intellectual Property

The App, including its software, design, logos, text, graphics, and other content (excluding content you create), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding. You retain all rights to the address data and content you create.

11 Third-Party Services

The App uses third-party services to operate, including Apple Maps and location services, Google AdMob, and Google's User Messaging Platform for consent management. Your use of these services may be subject to their own terms and privacy policies. We are not responsible for the content, accuracy, availability, or practices of any third-party service, including map data and navigation results.

12 Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that map, geocoding, or navigation results will be accurate or complete.

The App is a convenience tool and should not be relied upon as your sole means of navigation. Always use your own judgment and obey traffic laws, road conditions, and official signage when traveling.

13 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the App. To the extent liability cannot be excluded, our total liability to you for all claims shall not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or USD $25.

14 Indemnification

You agree to indemnify and hold harmless thehelloworld.app and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your content, or your violation of these Terms or applicable law.

15 Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App, or discontinue the App, at any time if you violate these Terms or for any other reason. Provisions that by their nature should survive termination will continue to apply.

16 Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, stop using the App.

17 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, excluding its conflict-of-law principles. You and we agree to submit to the personal and exclusive jurisdiction of the courts located within the County of Santa Clara, California, to resolve any dispute or claim arising from these Terms, except where applicable law provides otherwise. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in these Terms limits any mandatory consumer-protection rights that you may be entitled to under the laws of your place of residence.

18 Apple App Store Terms

This Section 18 applies when you obtain the App through the Apple App Store and sets out the terms required by Apple. These Terms serve as the end user license agreement ("EULA") between you and thehelloworld.app for the App. If any term in this Section 18 conflicts with another provision of these Terms, this Section 18 controls with respect to the App Store. To the extent these Terms grant you fewer rights or impose terms inconsistent with the Apple Standard Licensed Application End User License Agreement, the relevant terms of the Apple Standard EULA will apply instead.

(a) Acknowledgement

These Terms are concluded between you and thehelloworld.app only, and not with Apple Inc. ("Apple"). thehelloworld.app, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

(b) Scope of License

The license granted to you for the App in Section 4 is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where applicable.

(c) Maintenance and Support

thehelloworld.app is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

(d) Warranty

thehelloworld.app is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of thehelloworld.app.

(e) Product Claims

thehelloworld.app, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the App's use of the App Tracking Transparency framework. These Terms do not limit thehelloworld.app's liability to you beyond what is permitted by applicable law.

(f) Intellectual Property Rights

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, thehelloworld.app, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

(g) Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

(h) Developer Name and Address

The App is provided by thehelloworld.app. Any questions, complaints, or claims regarding the App should be directed to:

(i) Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App. For example, your use of the App's advertising, mapping, and location features may be subject to the terms of the relevant service providers described in Section 11.

(j) Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of these Terms.
