These Terms of Use (“the Terms”) are an agreement between you and OZ Inc. (“we”, “us”) about your use of HD Photo Enhancer & Restore (“the app”). By downloading or using the app you accept them; if you do not accept them, do not use the app.
They never leave your device, and we claim no rights to them — before or after enhancement.
4K, 4× and unlimited saves come with a weekly subscription billed by Apple.
In Settings → your name → Subscriptions. Pro stays on until the period you paid for ends.
This summary is here for orientation. The numbered sections below are the agreement.
1. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple-branded devices that you own or control, as permitted by the App Store’s usage rules. The app is licensed to you, not sold, and you may not copy, sell, rent, or redistribute it.
2. Your photos
You keep every right to the photos you bring into the app and to the enhanced versions it produces. All processing happens on your device and your photos are never sent to us, so we take no licence to them and could not use them if we wanted to — see the Privacy Policy.
You are responsible for the photos you choose to enhance: only use the app on pictures you have the right to use, and do not use it to infringe anyone’s rights, including privacy and publicity rights.
3. What the app does — and what it cannot promise
The app sharpens, denoises, recovers colour and light, upscales, crops and converts photos, entirely on your device. Results depend on the photo you start from. Upscaling and enhancement estimate detail that the original picture did not capture: the result is a better-looking rendering, not a recovery of information that was never there. Do not rely on an enhanced photo where accuracy matters — for identification, forensic, medical, legal, or evidentiary purposes.
Saving never touches your originals. The app writes each enhanced picture to your photo library as a new item and cannot modify or delete the photos already there.
4. Free allowance and the Pro subscription
The editor is free to use: every preset, adjustment, crop and format option, with one free save at the standard output sizes (Original, HD, 2K, or 2×). The 4K and 4× output sizes, and saves beyond the free one, require HD Photo Enhancer Pro — an auto-renewing weekly subscription.
The price is US $4.99 per week or your region’s equivalent; the exact price is always shown in the app and by the App Store before you subscribe. Eligible new subscribers get a 3-day free trial.
Auto-renewal — how Apple bills the subscription
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends, at the subscription's then-current price.
- You can manage or cancel it at any time in Settings → your name → Subscriptions on your device. Cancelling keeps Pro active until the end of the period already paid for.
- Any unused portion of a free trial is forfeited when you purchase the subscription.
Billing, receipts and refunds are handled by Apple, not by us. To request a refund, use Apple’s Report a Problem page. If we ever change the subscription price, Apple will tell you in advance and, where required, ask for your consent before the new price applies.
5. Fair use of the app
You agree not to reverse engineer, decompile, or modify the app except where the law allows it despite this term; not to circumvent the subscription; and not to use the app in any way that breaks the law.
6. Our intellectual property
The app — its code, design, presets, icons, and name — belongs to OZ Inc. and its licensors. These Terms give you no rights to it beyond the licence in section 1. Your photos are not part of “the app” and section 2, not this one, applies to them.
7. Changes to the app
We may add, change, or remove features, and new versions may require a newer version of iOS or iPadOS. If we ever change what is free and what is part of Pro, the change will not take away a purchase you have already made.
8. Warranty disclaimer
The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent the law permits. Nothing in these Terms takes away rights that consumer law gives you and does not let us exclude.
9. Limitation of liability
To the maximum extent the law permits, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data or profits, arising from your use of the app; and our total liability for any claim is limited to the amount you paid us for the app in the twelve months before the claim arose. Nothing in this section limits liability that the law does not allow to be limited.
10. Apple’s role
These Terms are between you and OZ Inc., not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claim about it — including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, consumer protection claims, or third-party claims that the app infringes intellectual property rights. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; beyond that, Apple has no warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
11. Ending the agreement
You can end it at any time by deleting the app; cancel the subscription first if you do not want it to renew. We may end your licence if you materially break these Terms. Sections 2, 6, 8, 9, and 10 survive the end of the agreement.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which OZ Inc. is established, without regard to its conflict-of-law rules. If you are a consumer, you also keep any protection given to you by the mandatory laws of the country you live in.
13. Changes to these Terms
If we change these Terms, we will update this page and the date at the top of it before the change takes effect. Continuing to use the app after a change means you accept the updated Terms.
